Ms. Phan will meet with you for an initial consultation she will have you fill out an intake form that she will review to  ensure everything is ready to move forward and that she will also use to assist her in drafting the petition documents. Not everyone has to be present. 

She will draft all the joint divorce petition documents. This will usually include the cover sheet, the affidavit of resident witness, the child support obligation sheet, the joint petition and the decree of divorce and the notice of entry. If there are other documents that become necessary she will draft those  as well. 

There will be multiple drafts of the petition and decree to make sure it comports with the law as closely as possible and respects the parties' intent. Revisions will continue until everyone is in agreement. 

Clients with children will have to complete the parenting seminar and obtain a certificate. Everyone will also have to obtain a signed and notarized affidavit of resident witness from a friend or relative. This can be completed at the office,.  

When all revisions are complete, all parties will arrive to the office to execute the final documents. The documents will also be e-filed the same day.  

When the Court grants the Decree, the parties will be notified and receive a copy. A notice of entry of decree will also be filed with the court. A Decree can be granted as soon as an hour to as long as a month. 

Clients can also request a certified or apostille copy of the Decree.
